Loyality Programme Terms and Conditions "Skarbonka LOVE"NS

I. Organiser

The Organiser of the Offer and the sponsor of the gadgets is Love Catering Sp. z o.o. registered in the District Court for the city of Kraków Śródmieście in Kraków, 12th Commercial Division of the National Court Register under the KRS [National Court Register] No. 0000736485, with the seat in Kraków, ul. Samuela Bogumiła Lindego 7, 30-138 Kraków, NIP{VAT No.]: 944-22-59-886, hereinafter referred to as the “Organiser”.


II. Definitions

The following terms used in these Terms and Conditions shall have the following meaning:

  1. Terms and Conditions – these Terms and Conditions of the Loyalty Programme organised by Love Catering sp. z o.o.
  2. Organiser – Love Catering sp. z o.o. with its registered office in ul. Samuela Bogumiła Lindego 7, 30-138 Kraków, KRS: 0000736485, NIP: 9442259886
  3. Participant Profile – a collection of information on services provided to the Participant at www.lovecatering.pl and information on the Programme.
  4. Programme – a loyalty programme run by the Organiser under which the Participant may obtain specific products or services in exchange for Points.
  5. Points – units assigned to the Participant’s account in the Service, obtained in exchange for the purchase of products or services provided by the Partner or offered directly by the Organiser.
  6. Participant – a natural person with full legal capacity or a legal person or a business unit without legal personality, voluntarily using the services of the Service.
  7. Service – a website run by the Organiser at www.lovecatering.pl.
  8. Registration – voluntary provision of data by the Participant/Partner necessary to take part in the Loyalty Programme by filling in the form available on the Service.

III. General Provisions

  1. The Loyalty Programme shall be run in the Republic of Poland.
  2. The Loyalty Programme is based on earning Points in connection with order execution by the User or other actions related to orders or meal assessments. The Users shall be able to use the collected Points when paying for meals.

IV. Participation in the Programme

  1. Any natural person who is at least 18 years old, has full legal capacity and is registered at lovecatering.pl may be a Participant of the Programme.
  2. The Participant declares that they have read the general terms, the rules of use of www.lovecatering.pl, and the Programme terms and conditions.
  3. The Points received by the Participants in the Programme of the Partner may be used only to receive discounts on the purchase of services at lovecatering.pl.
  4. The Participant Profile can only receive Points awarded to the Participant.
  5. The Participant or any person aware of violations may report them by sending an e-mail specifying the type of violation and the entity which committed it. Violations of the rules may be reported by sending an e-mail to the following address: hello@lovecatering.pl.
  6. The Participant may not copy, modify or distribute the content, photos, logos and works without the prior consent of an authorised person.
  7. The Participant using the Website shall observe the proprietary copyrights and the rights resulting from the registration of inventions, patents, trademarks, utility models and industrial designs of other Participants, Partners and the Service.

V. Programme Rules

  1. The Organiser shall ensure that the Service and the Programme operate properly at any time.
  2. The Organiser shall grant and make available the Points collected by the Participant by providing information about the Points on the Participant Profile.
  3. The Organiser reserves the right to block the participation in the Programme via the Partner if:
  • the contract and the terms have been breached;
  • actions to the detriment of the Organiser, Participant, other Partner or the Service have been undertaken;
  • false data have been provided;
  • the Partner has provided false or illegal information on the website;
  • the Partner has failed to perform, or improperly performed, their obligations for reasons other than force majeure.
  1. The Organiser who have obtained information about illegal activities of the Participants under the Programme shall immediately request to refrain from these activities.

VI. Points Awarding Rules

  1. The Programme is based on bonus sales under which, for the purchase of products or services of the Organiser, the Points are assigned to the Participant Profile (on the principles defined further in these Terms and Condtions). In exchange for the Points, the Participant shall be entitled to receive the following Bonuses:
    a) For each PLN 1 purchase, the Customer shall receive 0,01 Point.
    b) For each PLN 1 of the value difference resulting from the transfer from the cheaper diet to the more expensive one, the Customer shall receive 1 Point.
    c) For each 1 Point, the Customer shall receive a discount of PLN 1.
  2. The Points shall be awarded to the Participant on the basis of completed and fully paid orders with the Organiser or upon performance of other activities for which the Points are awarded. The information about the number of Points awarded and their validity period in connection with order execution or other activities shall be available on the Programme website.
  3. The Organiser may specify other activities for which the Points may be awarded.
  4. The Programme may be limited in time.
  5. The Points for transactions shall be awarded to the Participant only for completed and paid orders.
  6. If the transaction is cancelled and the Points have already been awarded, the Points can be revoked. The same shall apply to abuses and incorrect posting. Each time, the Participant shall receive details in e-mail.
  7. Having logged into the Profile, the Participant shall be able to see the number of the collected Points in the Service.
  8. Unless otherwise specified, the Points at the www.lovecatering.pl may be cancelled (Account reset) after 12 months from the last change in the Account balance. After 6 months from the last login to the account at www.lovecatering.pl, access to the Programme may be revoked and the Points shall be deleted.

VII. Complaints

  1. Any objections on the correctness of the calculation of the Points or the completeness of the Account balance notice may be submitted in writing to the main mailing address of the service or to the following e-mail address: hello@lovecatering.pl.
  2. The Organiser shall address the complaint within 14 days of its submission, confirm that the complaint has been accepted, and provide information on the complaint handling procedure, or specify that there are no grounds for accepting the complaint and justify it.
  3. The response to the complaint shall be sent to the e-mail address provided by the Participant/Partner.
  4. If the complaint has been accepted, the Organiser shall handle it immediately.

VIII. Resignation and Termination of Participation

  1. The Participant may resign from the participation in the Loyalty Programme at any time by submitting an appropriate declaration. The resignation shall be effective immediately. E-mail notification to the service address (hello@lovecatering.pl) from the address registered in the system shall be sufficient for confirmation of the resignation.
  2. For important reasons, the Organiser may terminate the participation in the Loyalty Programme. The following shall be regarded as important reasons referred to in the previous sentence: persistent action to the detriment of www.lovecatering.pl or any other breach of the participation terms. The decision to terminate the participation shall be sent to the Participant to the e-mail address registered at www.lovecatering.pl. The User who does not appeal against the decision within 7 days shall be deemed to agree with the Administrator’s decision.
  3. Termination of the participation in the Loyalty Programme leads to the loss of the Points collected and, in special circumstances, may lead to the complete removal of the account at lovecatering.pl.

IX. Suspension or Termination of the Loyalty Programme

  1. The Organiser may suspend or terminate the Loyalty Programme. The Participant shall be informed about suspension or termination of the Programme immediately but no later than 30 days before the suspension or termination of the Programme. This information may also be provided on the Programme website and on websites related to lovecatering.pl.
  2. During the suspension period and after termination of the Programme, the use of the points held by the Participant shall not be possible.

X. Final Provisions

  1. The Terms and Conditions are available at lovecatering.pl.
  2. The Organiser shall change the provisions of the Terms and Conditions for important reasons (e.g. amendment of the law). Prior to the changes, the Organiser shall inform the Participants/Partners of such changes by publishing the consolidated text of the Terms and Conditions on the Service and sending its content to the e-mail address indicated by the Participants/Partners. The amended or modified Terms and Conditions are binding if other conditions provided for by law have been met and only for legal relations arising out of the entry into force of the amendments or modifications, unless their content provides otherwise.
  3. Polish law shall apply to all rights and obligations arising from these Terms and Conditions.
